The time of "nobody fit know" is now behind us.

Nigeria's freelancer community, remote workers and digital creators have been operating in a grey area of the tax regime for years now. There was a huge amount of money to be made from payments from foreign clients, Upwork, Fiverr, and Payoneer that went unreported and, therefore, untaxed.

Not anymore.

The new tax reforms in Nigeria have upended the rules from January 1, 2026. You are now clearly in the tax net when you make foreign income while here in Nigeria. Here's exactly what that means, what you must do, and how to stay compliant .


The 2025 Tax Reform will have four pillars.

The reform is based on four fundamental laws that form a coherent tax system:


The Nigeria Tax Act (NTA) – reduces to a single tax code more than 50 tax laws.


The Nigeria Tax Administration Act – provides for a single procedure for registration and filing in all States.


The Nigeria Revenue Service Act – this is an act that replaces FIRS with a more technologically advanced Nigeria Revenue Service which will be able to keep track of digital payments.


The Joint Revenue Board Act - establishes formal mechanisms to address tax disputes.


Are You Affected? Understanding Tax Residency

The most important one is: tax obligation is based on residency, not the location of your client.


You are a Nigerian tax resident if you meet ANY of these criteria:


Owned in Nigeria and can be given permanent residency for the individual.


Possess significant economic and close family relationships in Nigeria


Have been physically in Nigeria for at least 183 days in a 12-month period. 


In such a case your income from all sources around the globe, including payments you received as a freelance from overseas clients, earnings from platforms and side hustles etc., is now taxable in Nigeria.


For instance, Tayo, a designer from Nigeria and currently residing in Lagos, makes a yearly income of N10 million from Americans via Fiverr. He is a resident of Nigeria and therefore his income is liable to tax in the country under Nigerian Personal Income Tax.


The Good News: The first ₦800,000 will be tax-free!

The new system has a generous zero tax band . When your taxable income, after deductions, is ₦800,000 or lower every year, you pay no taxes at all . You still need to register and file, but there is $0.00 due.


If you earn more than this, Nigeria now has a progressive system which means you'll pay varying rates on various amounts of your income.


Income Band Rate

First ₦800,000 0%

₦800,001 – ₦3 million 15%

₦3,000,001 – ₦12 million 18%

₦12,000,001 – ₦25 million 21%

₦25,000,001 – ₦50 million 23%

Above ₦50 million 25%

Your Secret Weapon: Expense Deductions

Freelancers have the flexibility of being able to deduct business expenses to lower the amount of income that is subject to tax as compared to traditional employees.


Typical deductible claims are:


Internet and data charges.Internet / data charges.


Subscription to software (such as Canva Pro, Adobe Creative Cloud)


Equipment (laptop, camera, microphone)


Apply materials from professional development (online courses, certifications)


Electricity bills (Work Use portion of bill)


Interest expense – up to 20% of annual rent 


Contributions to Pension & Health Insurance funds. 


For instance, Chioma made a total of ₦5 million from freelance design work. Her total taxable income went down from ₦14.01 million to ₦3.83 million, saving her ₦210,600 in taxes through these expenses such as business internet, new laptop, software, rent relief, etc.


What About Double Taxation?

Nigeria's Double Taxation Agreements (DTAs) provide relief if your income was already taxed elsewhere. Nigeria has DTAs with 15 countries . Even in countries that don't have treaties (such as the US) Nigeria has a unilateral tax credit (where they offer a tax credit for proof of foreign taxes paid, which reduces your Nigerian tax liability).


To help your business stay compliant, you have a 5 Step Compliance Checklist.

Step 1: Register and Get Your TIN

Enroll with your state tax agency (not federal). If you're not registered for a TIN, you might be unable to open bank accounts, register businesses or access government contracts .


Offence: Non-Registration of a subject for the first time – ₦50,000 fine; for subsequent months – ₦25,000 fine per month.


Step 2 is to Keep a Tight Record of All the Income.


Make sure to document all payments received from freelance sites and international clients.


Record payment amounts and dates.


Payoneer's, Wise's and bank account's transaction history.


Step 3: Foreign Income converted to Naira.


The foreign income should be declared using the official exchange rate of the Central Bank of Nigeria (CBN) on the date received, and not on the parallel rate.


For instance, Tunde earns $2,000 per month. If the official CBN rate is ₦1,470/$1 on receipt date, he declares ₦2,940,000, even if the parallel market offers ₦1,600/$1 .


Self-assessment returns are due once a year (Step 4).


Freelancers have to file before March 31st of the following year of the income year. Your return should include:


All gross income (from all sources)


All business expenses and business deductions


Calculated tax liability


Any withholding tax credits 


Step 5: Make a payment and collect credits.


If your clients have already paid Withholding Tax (WHT) before paying you, then claim WHT as a credit to reduce your liability at the end of the day when filing.


Penalties for Non-Compliance

When people don't do this, the consequences are serious:


If you do not register for TIN, it will cost you ₦50,000 for the first month and ₦25,000 for every month after that. 


Non-filing of returns: Monthly fines until filing: 


Mis-declaration/underreporting: Up to ₦3,000,000 fine or 3 years imprisonment. 


No payment of taxes: Interest + penalties + asset lien. 


The truth is that Your Income is already visible!

Many freelancers think that the money earned overseas doesn't show up in their income. It isn't .


Your foreign inflow can be seen by NRS and CBN if your Payoneer, Wise or Barter account is connected to your BVN or Nigerian bank. Even your overseas clients may receive automatic income with greater cooperation provided by international tax treaties.

Bottom Line

The new tax reforms are here to stay. There is no choice but to be compliant. There are, however, some advantages to the system as well: huge deductions and a zero-tax band of ₦800,000, along with double taxation protection.

The best approach: register, maintain a lot of documentation, make sure to monitor the expense, and file on schedule. It's better to be prepared than to incur any penalties later.
